These Terms and Conditions ("Terms") govern your access to and use of the HealthMint website located at https://healthmintblog.com (the "Site") and your purchase of any products from HealthMint LLC ("HealthMint," "we," "us," or "our"). Please read these Terms carefully. By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, do not use the Site.
1. Eligibility
You must be at least 18 years of age and able to form a legally binding contract to use the Site or purchase products. By using the Site, you represent that you meet these requirements.
2. Health and Product Disclaimer
Our products are dietary supplements, not drugs. They are not intended to diagnose, treat, cure, or prevent any disease. Statements about our products have not been evaluated by the U.S. Food and Drug Administration. The content on the Site is for informational purposes only and is not medical advice. Your use of our products and content is also governed by our Medical Disclaimer, which is incorporated into these Terms by reference. Always consult a qualified healthcare provider before using any supplement.
3. Products, Descriptions, and Availability
We strive to describe and display our products accurately, but we do not warrant that product descriptions, ingredient information, images, pricing, or other content are error-free, complete, or current. We reserve the right to correct errors and to change or discontinue products at any time without notice. Product availability is not guaranteed, and we may limit quantities.
4. Pricing, Orders, and Payment
All prices are listed in U.S. dollars and are subject to change without notice. Placing an order constitutes an offer to purchase; we reserve the right to accept or decline any order, including for suspected fraud, errors in pricing or availability, or violations of these Terms. You agree to provide accurate, complete payment and billing information. You authorize us to charge your selected payment method for the total order amount, including taxes and shipping. If a pricing error is discovered after you place an order, we will notify you and give you the option to confirm at the corrected price or cancel.
5. Subscriptions and Auto-Renewal
If you enroll in a subscription or auto-ship program:
You authorize us to charge your payment method automatically at the stated frequency and price until you cancel.
We will clearly disclose the subscription terms, billing frequency, and price before you enroll and obtain your consent to the recurring charge;
You may cancel at any time through your account or by contacting us as described in your subscription confirmation, and cancellation will take effect according to the terms disclosed at sign-up;
We will send any renewal or pricing-change notices required by applicable law.
6. Shipping and Delivery
We will make reasonable efforts to ship orders promptly, but delivery dates are estimates and not guaranteed. Risk of loss and title for products pass to you upon our delivery to the carrier. Shipping costs and timeframes are described at checkout.
7. Returns and Refunds
Unopened, undamaged products may be returned within 14 days of delivery for a full refund to the original payment method. To return a product, ship it to HealthMint LLC, 30695 Little Mack Ave., Ste 500, Roseville, MI 48066. Products must be received unopened and undamaged to qualify for a refund. Once we receive and inspect the returned product, we will issue your refund to the original payment method within 7–10 business days. Products that are opened, used, damaged, or returned more than 14 days after delivery are not eligible for a refund.
8. User Conduct
You agree not to use the Site to: violate any law; infringe the rights of others; submit false, misleading, or fraudulent information; transmit harmful code; interfere with the Site's operation; or attempt to gain unauthorized access to any system. We may suspend or terminate your access for any violation.
9. User Content and Reviews
If you submit reviews, testimonials, comments, or other content ("User Content"), you grant HealthMint a non-exclusive, royalty-free, worldwide, transferable license to use, reproduce, display, and distribute that content in connection with the Site and our marketing. You represent that your User Content is truthful, reflects your honest experience, and does not infringe any third party's rights. We may remove or decline to post any User Content at our discretion. User Content must not include claims that any product diagnoses, treats, cures, or prevents disease.
10. Endorsements and Material Connections
Some content on the Site, including reviews and posts, may involve a material connection — for example, the author may be compensated, may receive free products, or may earn a commission on sales. We disclose such connections in accordance with the Federal Trade Commission's Endorsement Guides. Any testimonials reflect individual experiences and are not a guarantee of results.
11. Intellectual Property
The Site and its content — including text, graphics, logos, images, product names, and the HealthMint name and marks — are owned by or licensed to HealthMint LLC and are protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the Site without our prior written permission, except as permitted for your personal, non-commercial use.
12. Disclaimer of Warranties
THE SITE AND ALL PRODUCTS AND CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY PRODUCT WILL ACHIEVE ANY PARTICULAR RESULT.
13. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, HEALTHMINT LLC AND ITS OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF THE SITE OR ANY PRODUCT. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR A PRODUCT WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE LIMITATIONS MAY NOT APPLY TO YOU.
14. Indemnification
You agree to indemnify and hold harmless HealthMint LLC and its owners, employees, and agents from any claims, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Site, your violation of these Terms, or your violation of any law or third-party right.
15. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Michigan, without regard to its conflict-of-laws principles.
16. Changes to These Terms
We may revise these Terms at any time by posting an updated version on the Site. The "Last Updated" date reflects the most recent revision. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
17. Severability and Entire Agreement
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect. These Terms, together with our Privacy Policy and Medical Disclaimer, constitute the entire agreement between you and HealthMint regarding the Site.
